1. “As Is” acknowledgement
ShotBrew is a tool that captures, records, and edits content on your Mac. By installing or using the Software, you acknowledge and agree that it is provided strictly “as is” and “as available”, with all faults, and that - to the maximum extent permitted by applicable law - you waive and release any and all claims against the developer arising out of or relating to any defect, bug, error, malfunction, interruption, data or recording loss, missed or incomplete capture, or any other incorrect, unexpected, or unintended behaviour of the Software. You assume full responsibility for selecting the Software to achieve your intended results and for the results actually obtained.
2. License grant & territorial availability
Subject to these Terms and to payment of the applicable fee (or an active trial), the developer grants you a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use one copy of the Software on the Apple Mac computer the license is issued for (see Section 3) and that you own or control, for your own personal or internal business purposes. You may use the Software, and any screenshots, recordings, or other output you create with it, for any lawful purpose, including commercially. This is a license, not a sale of the Software itself; the developer retains all rights not expressly granted.
Territorial availability. The Software is not offered to, and licenses are not sold to, persons residing in the European Union, the European Economic Area, the United Kingdom, or Switzerland. By purchasing or activating a license you represent and warrant that you do not reside in those territories. If we learn that a purchase was made in breach of this restriction, we may refund the purchase and void the license.
3. Trial, activation & device binding
- Free trial. New installations may receive a time-limited free trial (currently 7 days). When the trial ends, a paid license is required to continue using the Software.
- Lifetime license. A paid license is a one-time purchase that entitles you to use the then-current and future versions of the Software, including updates, for the lifetime of the product, on the device(s) it is issued for.
- Activation. To validate a trial or license, the Software sends a non-reversible, pseudonymous device identifier to the licensing server. It does not transmit your screenshots, recordings, files, or screen contents. See the Privacy Policy for details.
- Honest use. You agree not to tamper with, bypass, or interfere with license validation, and not to use a license on more devices than it was issued for.
- Device re-assignment. A license is issued for one Mac. If you replace your Mac, contact support and we will re-assign the license to your new machine free of charge - up to once every 12 months. We may accommodate additional re-assignments at our discretion (for example, a repair or warranty replacement).
4. Restrictions
You agree that you will not, and will not permit others to:
- sell, rent, lease, lend, redistribute, sublicense, or otherwise transfer the Software or your license, except where such transfer cannot be restricted under applicable law;
- copy the Software except as necessary for normal use and backup;
- reverse engineer, decompile, disassemble, or attempt to derive the source code, except to the limited extent this restriction is prohibited by applicable law;
- modify, adapt, or create derivative works of the Software, or remove or alter any proprietary notices;
- circumvent, disable, or interfere with security, licensing, or update mechanisms;
- use the Software to build a competing product, or in any unlawful manner.
5. Updates
The Software may check for, download, and install updates, including patches, bug fixes, and new features. Updates are an integral part of the Software and are provided on an “as available” basis. The developer may add, change, or remove features at any time and is under no obligation to provide any particular update, feature, or level of support. You can disable automatic update checks in the Software’s settings and check for updates manually instead.
6. Acceptable use & your responsibilities
You are solely responsible for what you capture, record, store, and share using the Software, and for complying with all laws that apply to you. In particular:
- You must have the necessary rights, permissions, or consents before capturing or recording screens, audio, cameras, people, or any content belonging to others.
- Recording audio and/or screens may be subject to consent, wiretapping, surveillance, workplace, intellectual-property, and privacy laws that differ by country and (in the United States) by state, including “one-party” and “all-party / two-party” consent rules. Compliance is your responsibility.
- You must not use the Software to infringe others’ rights, to capture content you are not authorised to access, or for any unlawful, harassing, or harmful purpose.
6.1. Sensitive content & redaction
Redaction, automatic sensitive-text detection, face detection, blur, pixelation, and related features are aids to editing, not a guarantee of confidentiality or complete anonymisation. ShotBrew may fail to recognise, locate, track, or cover information that you or another person considers personal, confidential, or sensitive. It cannot determine every user's privacy needs or every legal or contractual confidentiality requirement. A scan that reports no findings does not certify that the content is safe to share.
Cosmetic blur or pixelation of source content may leave information readable or recoverable. Redact replaces pixels within the covered area, but does not protect information outside that area or prevent a recipient from inferring information from context, other frames, annotations, audio, or other available material. We do not warrant that use of these features will prevent disclosure, identification, reconstruction, or unauthorised access by any third party.
You are responsible for deciding what needs protection, choosing the appropriate tools, and checking the final exported content before copying, publishing, or sharing it. For recordings, review the relevant frames and audio as well as any captions or generated guides. Do not rely solely on automatic detection or on the appearance of a blur or mask. Editing an output does not recall or erase originals or copies already saved, copied to a clipboard or clipboard manager, backed up, synchronised, or shared with another person or service.
7. Intellectual property & feedback
The Software, its design, code, trademarks, and all related intellectual property are and remain the property of the developer and its licensors. The content you create with the Software (your screenshots and recordings) belongs to you. If you choose to send suggestions, feedback, or bug reports, you grant the developer a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.
8. Pricing, trial & refunds
- The Software is offered as a free trial followed by a one-time purchase. Prices are shown at the point of sale and may change for future purchases.
- Purchases are made through a third-party sales platform (currently Getly). Payment is made with PayPal or with USDT / USDC stablecoins, processed by third-party payment processors (currently PayPal and NOWPayments respectively). The platform’s checkout opens in a separate window. The developer does not receive or store your PayPal credentials, payment-card details, or wallet keys. The platform’s and the processors’ own terms and privacy policies also apply to your purchase.
- Cryptocurrency payments. A stablecoin payment is final once it is confirmed on the network. Send the exact amount on the network shown at checkout; payments sent to a wrong network or in a wrong asset may be unrecoverable, and network fees are borne by you. The price is fixed in US dollars; any difference from the stablecoin amount at the moment of payment is handled by the payment processor.
- After purchase, you activate your license by submitting the purchase email and your Machine ID at shotbrew.app/activate; licenses are linked to your device within 24 hours of the request.
- Refunds. Because a free trial lets you fully evaluate the Software before buying, and in addition to any statutory rights you may have, the developer offers a money-back guarantee within 14 days of purchase - contact us and we will refund your purchase via the original payment method; for stablecoin purchases, in the same asset to a wallet address you provide, net of network fees.
9. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE DEVELOPER DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CAPTURE OR RECORDING WILL BE ACCURATE, COMPLETE, SUCCESSFULLY SAVED, OR PRESERVED. YOU ARE RESPONSIBLE FOR MAINTAINING BACKUPS OF YOUR DATA.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, OR FOR LOST, CORRUPTED, OR UNCAPTURED SCREENSHOTS OR RECORDINGS, ARISING OUT OF OR RELATING TO THE SOFTWARE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY. THE DEVELOPER’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SOFTWARE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (FOR EXAMPLE, LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD OR INTENTIONAL MISCONDUCT).
Sensitive-content disclosure. To the maximum extent permitted by applicable law, the developer is not liable for disclosure, recovery, reconstruction, inference, or unauthorised access to personal, confidential, or sensitive information in content captured, edited, exported, or shared using the Software, including loss arising from missed or incorrect detection, incomplete or ineffective masking, or reliance on redaction, blur, pixelation, or face-detection results. This exclusion is subject to the non-excludable liabilities above. If this exclusion is not enforceable, the other limitations in this section apply only to the extent permitted by law. Nothing in this paragraph limits our obligations under applicable data-protection law or the commitments made in our Privacy Policy about data we process.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the developer from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Software, your violation of these Terms, or your violation of any law or third-party right (including the rights of people or content you capture or record).
12. Term & termination
These Terms apply for as long as you use the Software. The license terminates automatically if you breach these Terms. The developer may suspend or terminate a license obtained through fraud, chargeback, or abuse of the licensing system. On termination you must stop using and remove the Software. Sections that by their nature should survive (including Sections 7, 9, 10, 11, 15, and 16) survive termination.
13. Privacy
Your privacy matters. Screenshots and recordings are processed entirely on your device and are never sent to us. The Software contacts our servers only to validate your license, to check for updates, and to redeem a promo code if you enter one. See the Privacy Policy for full details, including CCPA/CPRA information.
14. Changes to these Terms
The developer may update these Terms from time to time, for example to reflect new features or legal requirements. The “Last updated” date above shows the latest version. Material changes will be posted here, and your continued use of the Software after changes take effect constitutes acceptance. If you do not agree to the updated Terms, stop using the Software.
15. Governing law & disputes
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules, and the courts of Ukraine have jurisdiction.
16. General
- Severability. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions stay in effect.
- No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
- Assignment. You may not assign these Terms without consent; the developer may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and the developer regarding the Software and supersede any prior agreements on that subject.
